General sales terms and delivery conditions
§1 General
All prices on this website are without engagement! They should be regarded as an invitation
to bid.
Contrary terms and conditions of the purchaser are explicitely contradicted by the artist.
All deviations require the expressly consent of the artist.
§2 Intellectual Property
The images and designs used on this website, together with all software developed in
relation to it, are the property of Bernd Obergassel.
Copyright and Intellectual Property Rights remain with Bernd Obergassel even
after you buy the original work of art.
Purchase of any goods/works from Bernd Obergassel does not grant you any right other than that of
ownership of the product.
§3 Product Specification
Slightly deviation in measurements, weights, condition and quality are subject to change.
Please contact the artist first.
Dimensions quoted are for guidance only, contact me to ensure that you obtain precise
measurements.
Colours may not be exact due to reproduction limitations and resolution settings of your
computer/display.
Reproduction, distribution and modification is expressly prohibited for any purpose
unless otherwise specifically agrred by Bernd Obergassel.
§4 Settlement
All prices on this website are in EURO (EUR). Ex works!
Bernd Obergassel reserves the right to modify the prices on this website from time to time.
Every effort is made to ensure that prices are correct, however customers should
confirm the price of goods/works at the time of making a purchase.
Note: Prices do not include packing, postage and insurance.
§5 Payment
The artist insist on sale against cash in advance.
After receiving your placed order of one or more works of art by email or mail the artist sent you
a confirmation and let you know the amount you have to remit to his bank account.
When payment is received (by banker's transfer) to the bank acount he will sent you an
acknowledgement in return.
§6 Delivery
Delivery will be made by a national (or international) forwarding agent.
Costs of packing, carriage and insurance are on buyer's account or have to be prepaid.
You can suggest a forwarding agent who specializes in the organization and management
of art/exhibition transports and is experienced in handling art.
Returns must only be carried out with the artists consent.
Please note that if you are requiring delivery of goods/works to an address out of the
European Union you will also be responsible for any duties levied in that country.
§7 Cancellations
Orders may be cancelled at any time prior to the goods/works being dispatched; unless they have been
made to your specification or personalisation, or where the artist has already begun framing or packaging
the goods/works or when he has started any other agreed service on them.
§8 Disclaimer
This site and all contents of the site are provided on an "as is" basis without warranties of any
kind, either express or implied, including without limitation warranties of title or implied warranties
of merchantability or fitness for a particular purpose.
You acknowledge, by your use of this site, that your use of this site is at your sole risk, that you
assume full responsibility for all costs associated with all necessary servicing or repairs of any
equipment you use in connection with your use of this site, and that Bernd Obergassel shall not
be liable for any damages of any kind related to your use of this site.
§9 Governing Law
These terms and conditions are governed by German law and all parties agree to submit to the
non-exclusive jurisdiction of the German Courts. Place of jurisdiction is Dortmund, Germany.
